
TERMS OF SERVICE
Terms of Service for Social Media Sidekick
1. Subscription and Payment Details
The Social Media Sidekick is offered as a monthly subscription service. All subscriptions and payments are processed and managed via Stripe.
By subscribing, users acknowledge and agree that:

It is their responsibility to manage their subscription details within Stripe, including keeping payment information up to date (such as card expiry dates and CVV/CVC codes).

Failure to maintain valid payment details may result in unsuccessful renewals and automatic termination of the subscription due to non-payment.
Subscriptions are billed monthly in accordance with Stripe’s subscription renewal logic. Where a subscription is initiated on a date that does not occur in a subsequent month (for example, the 29th, 30th, or 31st), Stripe will align the renewal to the last valid calendar day of that month.
Example:
If a user subscribes on 31 January, the next billing date will fall on 28 February (or 29 February in a leap year), and subsequent renewals will continue on the last applicable day of each month.
Failure to cancel a subscription prior to the next billing date does not automatically entitle the user to a refund. Refund reviews may only be requested where no content has been delivered for the current subscription month, with the final decision resting solely with A Little Social.

2. User Responsibilities and Acceptable Use
Users must provide accurate, timely, and relevant information about their business, brand, and monthly content requirements. The quality and relevance of AI-generated content is directly dependent on the quality of information supplied by the user.
A Little Social accepts no responsibility for content quality where insufficient, inaccurate, or unclear information has been provided.
Users must not submit profanity, offensive language, unlawful content, or inappropriate material via any forms or data collection mechanisms used as part of the service. Breach of this requirement may result in immediate suspension or termination of the subscription without refund.

The service is intended for reasonable business use only. Excessive, abusive, or exploitative use of the service may result in suspension or termination at A Little Social’s discretion.

3. Intellectual Property and Content Ownership
Upon full payment of the applicable subscription fee, users are granted ownership of the final AI-generated content delivered during their subscription period.

A Little Social retains ownership of all underlying systems, workflows, templates, prompts, methodologies, automations, and processes used to deliver the Social Media Sidekick service.

Users may not reproduce, resell, sublicense, or represent A Little Social’s systems or service as their own.
4. Content Use, Accuracy, and Compliance
All AI-generated content is provided “as is” and is intended for general marketing and informational purposes only. It does not constitute legal, financial, advertising, or professional advice.
Users are solely responsible for reviewing, editing, approving, and publishing content, and for ensuring that all content complies with applicable laws, advertising standards, and platform-specific rules and policies.
A Little Social accepts no responsibility for penalties, account restrictions, content removal, or other consequences arising from published content.
5. Liability and Disclaimers
A Little Social makes no guarantees regarding specific outcomes, engagement results, performance metrics, or business results achieved through use of the service.
To the maximum extent permitted by law, A Little Social is not liable for any direct or indirect loss, damage, or consequence arising from the use of AI-generated content.
Where a user believes content is materially deficient despite providing complete and accurate input, they may request a review. At its discretion, A Little Social may regenerate content for that subscription period.
6. Use of Third-Party Platforms and Integrations
The Social Media Sidekick service may utilise third-party platforms, tools, automations, and integrations to deliver the service. These may include, but are not limited to:

OpenAI
-
Stripe

Google Gemini

Google AI Studio
By subscribing, users acknowledge and agree that:

Certain user data may be shared with third-party platforms strictly for the purpose of delivering and operating the service.

A Little Social is not responsible for service interruptions, delays, or failures caused by third-party platforms.

Users are deemed to have accepted the terms of service and privacy policies of all third-party platforms utilised.
7. Service Availability
While reasonable efforts are made to maintain availability, uninterrupted access to the service is not guaranteed.
A Little Social is not liable for delays, failures, or interruptions caused by technical issues, third-party platforms, or events beyond its reasonable control.

8. Privacy and Data Handling
User data will be handled in accordance with applicable Australian privacy laws. Reasonable steps will be taken to protect personal and business information supplied by users.
No additional international data protection frameworks are expressly adopted unless required by law.
9. Cancellation Policy
Users are solely responsible for cancelling their subscription via the Stripe platform. Cancellation must be completed prior to the next billing date to avoid further charges.
Failure to cancel a subscription does not guarantee a refund. Refund reviews will only be considered where no content has been delivered for the current subscription month, with the final determination made by A Little Social.
10. Failed Payments
In the event of a failed payment, Stripe will automatically attempt to retry the charge multiple times within a two-week period.
If payment remains unsuccessful:

The subscription will be placed in an unpaid state.

A Little Social may contact the user via their nominated email address to confirm whether they wish to reinstate or cancel the subscription.
If no response is received by the end of the subscription period, the subscription will be cancelled.
11. Use of Business Information
A Little Social reserves the right to collect and store relevant business and subscription information for internal operational purposes.
This information may also be used to communicate updates or market future products and services relevant to the user’s business. No personal or business data will be sold or shared for unrelated purposes.
12. Changes to the Service or Terms
A Little Social reserves the right to modify, update, suspend, or discontinue any aspect of the service or these Terms at any time.
Continued use of the service following any updates constitutes acceptance of the revised Terms.
13. Termination of Access
A Little Social reserves the right to suspend or terminate access to the service where these Terms are breached, the service is misused, or continued use may cause harm to the business or its systems.

Termination does not entitle the user to a refund unless required by law.
14. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of Queensland, Australia. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
